Harvey Birdman stood up. "Objection! Just because -someone ELSE- had a weapon does not mean that the girl would pick it up. She has never used a physical weapon in any records presented and to decree she -could have- grabbed one is a statement that even refutes his own arguments. So the witness should have 'grabbed up a weapon' to avoid being hit by someone else who has physical prowess? Then he would be charging Namine with drawing a weapon and presenting a possible threat to Larxene, which is clearly not the case. This does not help his own case at all and he is once again trying to pass the buck instead of examining the scene at hand with hypothetical toss-ins."

Harvey then gave a curt nod as something else crossed into his mind. "Also, the Keyblade may not even have stood in her hands since it is choosy about its wielder and would merely have gone back to Sora. Therefore the girl clearly was without a weapon and even if there were one, why should she pick it up? Does Namine even -know- how to use a weapon? I'm sure the Defense will try to say that then she felt she was in 'no immediate danger' but the point also can rest on the fact the witness has never used a weapon and may very well not know how to, which is what kept her intimidated her whole time in the Castle Oblivion."

Naminé nodded. What Mr. Birdman said rang true. As far as she could remember, she never had a physical weapon. Let alone, she didn't even know how. Her powers were only good on Sora and whoever's hearts it came in contact with. They wouldn't have worked on anyone else. Most of the Organization were all Nobodies after all, so they had no hearts that could be affected.

As for this "twitch" the defense thought he saw...

"Mr. Xelax. I've been an observer for long enough to know when someone's grasping. The only reason I looked at Mr. Power is because he reminds me a lot of Larxene in terms of affinity and ability. I mean..." She gave the Pikachu an apologetic look. "...other than his stubby arms and legs. No offense."

Kairi facepalmed herself. Why the heck did Naminé make a comment like that? She already insulted Riku. Kairi hoped that she didn't insult the prosecutor as well...

 

Pika_power grinned at Namine, striking a 'Rock lee' pose. "The only difference between the accused and I is that I don't bite off more than I can chew."[/QUOTE]

Pika_power was confused, plain and simple. "So, what pretense are you trying to defend Larxane under? Is it Namine could have picked up the keyblade? That Namine is a keyblade wielder in disguise? Even if she did pick it up, she could not use it.

This is more ridiculous than the weapons charge. You are trying to get Larxane out of smacking a child around by saying Namine could have used the keyblade? If that is justified, then I want the weapons charge brought back. I mean, not safe having these people walking around with the ability to summon weapons. In fact, any passerby that goes within 5 meters of them should go to court too, as they might be able to use the weapons!

Pah, ridiculous. Yet it is the same thing here. You are saying that Larxane was allowed to hurt Namine, because Namine was standing a few feet away from someone else's weapon that had a good chance of leaping out of her hand.

Also are you suggesting that a girl who's only experience was with colouring pencils, and who was sitting down for most of the game could seriously hurt Larxane?

Namine made no move towards the weapon. To 'punish' someone for the chance of them doing something when there is no proof of it ever happening, is insane.

I am not amused Xelax." then to the judge "Get this farce over with. If this is the best the defense has to offer, Larxane would be better off pleading guilty."

Turning away in disgust, he looked over at the accused. Demyx was creeping towards Axel's (empty) skittle bag, and Goofy had just landed on him.

OoC: Amber, Anwita said the bag was eating empty a couple of pages ago. At the moment the only person who has any skittles is Lexaeus, and even he lacks the yellow skittles Stitch gobbled. Pika_power offered Axel the other colours of skittles in return for the damage of Stitch. Axel did not do it, so when Lexaeus entered the court and half killed Stitch, Pika_power gave him the bounty. I hope you understand the skittle plot now!

 

Kairi let out a sigh of relief. The thought of the prosecution being insulted was almost too much to bear. She silently hoped that after Naminé left the witness stand, she and Riku would finally make up.

Amused by the whole "Skittle Scandal," she reached into her purse and pulled out a mega-bag of it herself. She opened it up carefully and realized that somehow the factory messed up. Because the bag of candy was none other than...

...Yellow Skittles. A full bag of them. Kairi glanced around. No one seemed to have noticed yet...

 

Harvey looked at Pikachu. "No, I disagree about the weapons charge. Assault and Aggravated Assault are better and more proper charges. There is no law against possession of a weapon in this universe they are from. You weaken the case continuing to bring it up. I see where you are going but let's not bring the weapons charge up anymore, please."

Riku rubbed his eyes. Now the Prosecutors were debating and not agreeing on calls. This was not going to be good. They both had two different approaches and in some ways the court seemed more a mad house with lightning bolts flying than it did such a serious case. He supposed that was a good thing to ease people but at the same time, it was distracting. Why the hell were Skittles so important to trying a group of people for various crimes? Maybe he should buy some later and find out.

"Oh jeez, come on" Sora muttered. "This is getting so confusing." He hoped Namine would hang on just a bit longer. They had to be done with her soon enough. He reached into his pocket and took out a caramel, unwrapped it and started chewing on it. Mhmm..tasted good. Food always makes things better.

Repliku meanwhile yawns and looks under his seat to see if there are any Oprah notes that decree he's won a new car. None were spotted so he began checking out around other seats by him. No one was sitting by him any way.

 

"Skittles?" she asked Riku as she quietly offered him the bag. That's when Kairi noticed something particularly odd. No, it wasn't the courtroom. She had seen enough fantasy to know that things weren't always what they seemed. And when it came to this particular court and its judge, anything could happen.

What was bothering her was Janexna was watching the whole thing silently as if deep in thought. So far Xelax had been calling all the shots. That might be the reason why the prosecution was arguing right now. Janexna was letting her partner do most of the work. It was pretty much a two-on-one match. The prosecution was strong, but only if they could agree. If not, even Xelax himself would be able to take them both on without any problems.

As nervous as Naminé was, she was beginning to feel a little restless. Was she done here? Did she prove the prosecution's case? As her eyes scanned the audience, she realized that she had never apologized to Repliku. Shaking her head, she cursed herself. First Repliku and now Riku. She wondered if she would EVER be able to make it up to them both...

 

The pokemon sighed at what Harvey said. "But Harvey, I am using it to prove how strange the current defense is. If Larxane can get off on that Farce, we should be able to bring back the weapons charge. If Larxane is legally allowed to attack a child for standing near a weapon, I see no reason why we cannot put her legally in jail for holding a weapon at certain times. We can have Aggravated Assault and possession of weapons..."

Pika_power fell short. He was not strong enough to disobey Harvey Birdman. It was the curse of being a pokemon.

Pika_power saw a flash of yellow, and noticed a whole bag of yellow skittles. Rather than cheering him up, it just made him more depressed, as the bag was on the the highest seat in the witness box, far out of his reach.

Goofy looked around for a bit, then siad 'Gawsh, all my friends have turned into organisation members!" He grabbed the member who was sitting in the same place as Sora. It just happened to be Xemnas. Shaking him violently, he called out "Sora, Sora, can you hear me? Are you still in there?" "He's over here!" Donald called out. "Now stop messing around and- BWAWWAWAWAWAWWAWA!' Donald just noticed who Goofy was still shaking and yelling at.

 

"Uh...guys? Would you not do that to Xemnas..please?" Sora was just lost at the antics going on. He almost wanted to chuckle at first but decided that might make Xemnas well...mad. "I'm over here, Donald and Goofy!"

Birdman gave a nod to the Pokemon. "I hear what you are saying but the weapons charge was dropped for a reason that it doesn't work in the case. His issue could be dropped by what other things we said. Now we have to work together and stay focused, ok?"

Repliku groaned. "Why aren't there any concession stands in this place? All anyone has to eat is candy!" *humphs*

Riku glanced over at Kairi and nodded. "Sure" holding his hand out for some.

 

OOC: I am laughing so hard right now.... its hilarious... Goofy calling Sora... the Skittles scandel... everything!

I also agree with Kairi's opinion of the court case. I know you guys are stronger than that.

Xelax looked over at Birdman and Pika_power. "Well, you see, thats not what I was implying. She had something else at her disposal. Something far more dangerous than the Keyblade. Something that was responsible for reducing to nothing more than her tool. Something she had planned to obtain from the begining!"

"Why else would she stay in Castle Oblivion. Why else would she manipulate Marluxia and Larxene. You see, Marluxia and Larxene may have had a plan forged out, but they were foolish. They did not coerce an innocent little girl. But rather... THEY WERE COERCED BY A LITTLE GIRL!!!"

He took a moment to calm himself. "If you look at the evidence we can clearly see what happened."

"Why was Ms. Namine in Castle Oblivion. Frankly, because it benefited her."

"She was there because thats where she draw her power to manipulate memories. Her power was amplified by being there."

"However it was here where something did not go according to plan. Organization XIII appeared. Marluxia claimed ownership of the castle. Then Namine sensed Sora's presence, and called him closer... but she did not do it because she was coerced, but because she was lonely."

"But Namine was not trapped in her situation. She had a way out the entire time if things went badly. A way out that she kept hidden from Marluxia..."

"But he really couln't have done that... you know why?" He then presented more evidence...

"Now why would Namine refuse to leave when she had the opportunity the entire time? She was enticed by the prospect of living a life with Sora as her watch dog. Marluxia and Larxene were merely victims of Namine's evil mastermind. I motion that the charge coersion of Sora and Namine against Marluxia and Larxene be dropped on this account. And that the child abuse charges on them be considered self defense... and we know why..."

"Recall what Namine said when I asked Ms. Namine what happened when Sora knocked the weapon out of Larxene's hands."

"Child abuse is a law designed to protect the innocent. Not the dangerous and the deadly. If the charge is not dropped, then the law is being misapplied. Larxene and Marluxia both acted in self defense."

 

OoC: Wait a sec, aren't I the one playing Lexaeus? Because on the first page it says that Daxma is playing him and Zexion.

Lexaeus saw the dog land on Demyx's lap and shake Xemnas. He reached into the bag for a skittle to calm his rising ager. The skittles were gone! Looking back at Demyx, he found a shocking sight. A red lacy pair of women's underwear was hanging from Demyx's pocket. No one had noticed it yet.
Lexaeus' eye twitched. He picked the dog up by its collar and hurled it at the angry, quacking duck. There was a very audible crash as it landed. Most of the Organization were looking at him.
"Find me skittles and no one else gets hurt." The Silent Hero gave his ultimatum.
Lexaeus was pleased. Xelax was pressing hard, giving no ground. He had never really liked Larxene, but he was glad that she had such a skilled defence. Lexaeus had never really met Namine, but the threat that she posed had spurred him, Zexion and Vexen to use Riku. The Silent Hero resolved to keep clear of Repliku and Riku. He didn't want a courtroom brawl.
Lexaeus looked down at the empty skittle bag. He had a thought, what if Pika_power was bribing him with skittles? He'd never betray the Organization but... he could taste the rainbow with every bite...
Lexaeus rubbed his head. He was getting annoyed, and if he didn't find some skittles, or a way to vent, he might end up powering up and knocking everyone over.
He spotted Stitch. Their eyes locked, and Lexaeus gave an evil smile. Stitch gulped. Lexaeus raised the empty bag of skittles, pointed to it, and made a fist. Stitch got the message. Go get some skittles, or I start hurting you.

 

Heres why...

Its my job to make Org XIII look innocent... its kinda hard to do when one of them is threatening a kid for Skittles...

Plus you did not audition as I asked, Daxma did, and I liked his audition.

OOC: I knew you were going to go with this angle. But fortunately, I can counter it. And yeah, the Skittles thing is just messed up, lol. Sora just hopes Xemnas doesn't take it all out on him at this point. lol



Namine's statements and Roxas's show nothing that states that Namine could leave the Castle Oblivion whenever she wished to. Also, if he wishes to state Namine could use Dark Portals, let us bring up the point that in the Castle Oblivion, she never Dark Portaled once, which is very probable due to the fact Marluxia ran the castle and could prevent this. Without Xemnas or Marluxia reigning over her to keep her contained this ability could be used. There is -nothing- to say that she was not imprisoned at the Castle Oblivion.

Also on the note of Marluxia owning the Castle Oblivion, if the others suspected a coup, why didn't they confront Marluxia direct instead of trying to use Riku? It is obvious that he had the power here even if all of the others could have taken out two Nobodies on their own. By stating that Namine had control of the situation you also state that Luxord, Zexion and Vexen could have done more against Marluxia and did not. They all were stuck there under orders from Xemnas as well as the control Marluxia was granted over the castle. You ruin your own Defense by stating otherwise. Also, on account, she did flee when Axel gave her the ability to do so which shows the Organization did in fact have control over what she did there. Also, she -did- run off when given the opportunity by Axel so this discounts the statement that she could have left at any time and why didn't she."

As for the charge that the witness went to the Castle Oblivion prior to Marluxia being set in charge of the castle so that she could use her powers ahead of time because her bond there would enable her to use her memory powers...who is to say that Xemnas did not place Marluxia in charge of both the Castle Oblivion AND Namine and set her there in the first place? You will need to present factual evidence and not hypothetical scenarios if you want to back this up and if you cannot I call for it to be stricken from the records because it is not evidence but speculation on the part of the Defense."

Birdman would let the Judge side and hope he would go with the Objection. This was clear rubbish with nothing to support it but the girl could Dark Portal later and did no such thing prior. Everything else appeared to be just allegations. Harvey fussed with his tie as he waited for the judge's verdict.

 

OOC: I would have been dissapointed if you did not counter...

"On the contrary. She could come and go as she pleased. I backed up that she could portal and come and go as she pleased. You however did not back up your statements with evidence." Xelax expected the Objection from Harvey Birdman, and countered.

"The reason the other Organization members did not confront Marluxia directly was becuase Marluxia was stronger than them, and they also thought he controled Sora, who was even stronger. They were unaware that Namine was playing both sides."

"Also, did Namine flee? Leaving the castle running in fear? Or did she run too Sora, securing her weapon against Marluxia and Larxene?" He once again smirked with confidence smelling victory coming closer. And he did all this only using Namine's testimony and the evidence he had at hand.

 

Birdman was determined to push the point. "Wrong. There is no proof at all to show Namine had the power to leave the Castle Oblivion by what you have shown. Just because she could Dark Portal does not imply she had the power to leave. The Castle Oblivion was under the command of Marluxia and therefore he could control what people did in it. Also I'd like to present the fact that Vexen did speak against Marluxia and was promptly held in check ONLY because he was threatened with Larxene and Marluxia going to Xemnas over his 'failures' which it is presumed Xemnas would have punished Vexen for. Also, he was reminded that Marluxia was left in charge and that was the way it is."

"I submit this evidence to show this."

"This clearly shows that Vexen, who is a top member of the Organization and one of the Original members was bullied into submission NOT by Marluxia's power but by the fact that Marluxia was granted control of the Castle Oblivion. He is also conned by the fact that failure in Xemnas's eyes AND betrayal which he was charged with are to keep him in line."

He sipped from the glass of water. "And lastly, it proves the point that Marluxia was IN FACT without a DOUBT placed in charge of the Castle Oblivion AND Namine. Therefore she was held there under him and was in fact a prisoner. All charges should therefore stand."

 

Xelax pounded his fist on the rail. "Your dodging the subject Mr. Birdman. The subject is that Namine had a choice, and chose to be in the situation she was in, and held more cards than either Marluxia or Larxene, so she couldn't be coerced. The subject of Marluxia outranking Vexen is a useless point, it does not affect the case."

 

Harvey grinned. "Wrong, I addressed the issue by the Org's own statements. The point is that Xemnas did indeed pass the Castle AND Namine to Marluxia which suggests that Xemnas knew of the girl and made her incapable of leaving. There is nothing to refute the point that the Castle Oblivion is indeed Namine's first place of memory that you have in your notes. There is also nothing to declare that though she could Dark Portal later that when she was held in control of Marluxia, that she was not bound to the Castle and Dark Portal simply may not have been an option. Note -none- of the Organization left and also the fact that Repliku could also Dark Portal but even after he parted from Sora it would appear he also was stuck at the Castle, which obviously the boy might have wanted to get away from there if he had the option. The only people that left the Castle in the end were those AFTER Marluxia had been dealt with. Saying that Namine had the power to leave and used the Organization for her own benefits, blaming her for the entire events is foolish and dodging the truth. In other words, you are twisting the scene to fit your need and there is no proof at all to say that Namine's testimony is fraudulent."

After having stared at Janexna for a moment, blinking at her with a very confused face, as if both were caught stealing something, Axel looked away. He was still disappointed that he'd finished his deliciously fruity bag of skittles. What he wouldn't do for another bag. As he looked around, it seemed that almost everyone in the courtroom either had or wanted a bag of skittles. He gulped in both amusement and confusion and looked down at his now empty packet. With only the thought of having more skittles in his mind, he completely ignored all the screams of 'objection', the debating, and the ongoing examinations concerning Larxene and Marluxia's fate. He stated at his empty bag when suddenly the Pikachu had appeared in front of him, completely out of the blue. Jerking slightly in surprise, he twitched to suddenly find a yellow fur-ball in front of him.
“Hi...†He began. But the Pikachu broke in. He was actually offering him his skittles if he was willing to 'fry' the alien thing hanging from the roof. 342 Skittle... not a bad trade, he thought, but was it worth it? He stated at the Pikachu with wide eyes, raising an eyebrow considering the proposition left by him, and watched him scurry away. He Crossed his arm and thought about this for a moment. He did want more skittles, of course he did, but the act of acquiring those skittles meant that he'd have to resort to violence. He curled his lips, still looking at the empty bag of skittles in his hand, looking up after a moment only to find the Pikachu waving the bag of skittles at him from his desk.
“Wha—†He mumbled. His green eyes literally moved with the bag, and he could've sworn that a drop of drool had slipped through his lips.
Unbelievable! Axel snapped out his daze and hypnotized form. He averted his eyes from the luring bag of Skittles and narrowed his eyes at the Pikachu. That clever little sneak! He was manipulating him to use violence in court, in front of the judge and all the lawyers! Though he wanted the bag of skittles more than ever, attacking and 'frying' Stitch in the middle of the courtroom would only ruin his reputation and the prosecutors would probably be bringing that up in court when it was his turn to be tried. He gritted his teeth and poked out his tongue at the Pikachu before leaning back on his chair and crossing his arm. It wasn't long before Lexaeus took his stab at the alien, and the Pikachu, merely giving him a small smirk, threw the bag of skittles at the hero. With out moving his head, he watched the bag fly across the room and land in Lexaeus's lap, and there was absolutely nothing Axel could do about that, so he sat there clenching his fist.
As Axel sat there grumbling about not having any skittles, Demyx finally walked in and took his seat besides him. Oh yes, he was right on time... the trial had begun back at eight o' clock AM... considering the time now, he was only two hours late.
“Did you forget about today or what, Demyx?†He asked him bitterly, venting his frustration of the loss of skittles on the poor Nocturne. Axel only gave him a cold stare as Demyx poked him for his skittles. Ah, the skittles again! Wasn't there anything else in this world besides those sweet, deliciously charming and fruity, colorful, rainbow tasting skittles. The thought of the skittles made him space out again as he imagined himself in a field where it was raining skittles. He didn't notice when Demyx was slowly creeping his hands trying to snatch the packet of skittles, but little did he know that it was empty. However, both Axel's daydream and Demyx's concentration was broken when that dog like creature... G-Goofy... right? .... had suddenly landed on Demyx's lap.
“Whoa!†He yelped in shock, his head shooting up and eyes scanning across the room to see some kind of commotion on the other side. But before he knew it, Goofy was violently shaking Xemnas, and calling him... “Sora� He raised an eyebow at the violent shaking of Xemans continued. He always knew there was something wrong with those people.
Axel opened his mouth to protest against this kind of behavior against the superior... but he paused, his index finger raised in the air. Looking at the baffled and shaking figure of Xemnas, a smile came across Axel's face. He never did like Xemnas, so he leaned back on his chair watching this particular spectacle rather than the case. He'll allow this to happen for the time being without any objection.

 

Xelax replied, "Sorry Harvey... I reviewed the evidence you submitted. And I fail to see how it shows Xemnas was aware of Namine. All it shows is Marluxia was put in charge of castle. It doesn't even use Xemnas name in the transcript. But we know Marluxia was appointed by someone. But it is not relavent to the situation at hand. That Namine was not as helpless as she made herself out to be."

OOC: I'm tempted to change my character to Kristoff Gavin... but oh well... I'm Xelax now.

 

"I believe that you are missing the point that both proofs are within the points I gave you. Let me spell it out for you." Harvey took out the paper and read once again...

Marluxia clearly states that the castle and the girl Namine have been entrusted to HIM. Defy Marluxia and you defy the Organization. Now who has the power to entrust the Castle Oblivion AND the girl to Marluxia? Obviously, Xemnas. If you need more proof..."

"So basically, if he has someone who has failed, he must report the progress to the Superior. The Superior is a title for none other than Xemnas, correct? This implies that Xemnas is the one who gave him the permission to run the Castle Oblivion and also have dominion over Namine. Namine could not leave the castle because Marluxia was placed in charge of it AND her. No dark portal is an issue in this. It was NOT an option. It is Marluxia and Larxene that committed the coup against Xemnas and the Organization. It is not Namine. She was a tool, pure and simple. Unless you have ANY proof other than the fact that AFTER she left the Castle Oblivion and was freed by Axel that she could open portals in the castle oblivion, you have lost this match."

"AAAAAAAAAaand on a final point, Axel is the one in your own proof shown that verifies to Sora where Kairi is held. It is AFTER this that Namine goes to free Kairi. Now if Axel met Sora in the realm they were at, which in fact he did, who is to say Axel did not lead Namine to the World That Never Was. She could not have been this great conspirator you make her out to be because she was lacking in information. It is clear Xemnas put her where he wanted her and it is undeniably shown by Marluxia's own statements that she was HIS as was the Castle Oblivion to do with as he saw fit." Harvey wonders where coffee is at this point... "Someone, if you'd get me a cup of coffee, I'd be grateful. It's going to be a loooooooong trial"
