    with diamond dudes effect, you never activate the spell card, only its effect, so it's activation condition is irrevlevent.

    although, this is UDE, so if a tourney player disagrees, it may have changed.
    here is the OCG ruling, from the same yugioh wiki page.
    here is a google translated FAQ answer from konami, which clearly says diamond dude activates the card's effect, and the card itself doesn't activate, but doesn't specifically say anything about activation conditions.

    additionally, from yugioh wiki's page on activation,

    you can't play a card, and have it's effect fail to activate, and you are forced to set ZERO-MAX before you activate it, because it says 'Activate only if you have no cards in your hand.' so I would assume that the activation condition is part of the spell card's activation, not the effect's.

    i used the same combo on over the nexus and it let me without the dark monsters in my grave and jaden i was not using it this turn
